Terms and Conditions

These Terms and Conditions explain how RiseDigital provides website design, development, hosting, support, and related digital services. By requesting a quote, approving a proposal, paying an invoice, or asking us to start work, you agree to these terms.

These terms are intended for Australian customers and should be read together with any written quote, proposal, invoice, package description, email approval, or project agreement we provide to you.

Project scope

Each project includes the pages, features, and services agreed in writing before work begins. Extra pages, new features, major copy changes, third-party integrations, or additional design rounds may be quoted separately.

If something is not listed in the agreed scope, it is not automatically included. We will let you know if a request is outside the original scope and whether extra fees or extra time are required.

Client responsibilities

You are responsible for providing accurate business information, images, logos, content, access details, and feedback needed to complete the project.

You are also responsible for checking that content supplied to us is accurate, lawful, not misleading, and that you have permission to use any text, images, logos, reviews, testimonials, trade marks, or other material you provide. This includes making sure business claims, prices, service descriptions, guarantees, and legal notices on your website are correct for your business.

Approvals and changes

We may ask you to review and approve designs, content, or website previews. Once you approve a stage, later changes to that stage may be treated as additional work if they are significant or outside the agreed revision allowance.

We can usually make reasonable small changes as part of the project. Larger changes, new directions, new pages, new integrations, or changes after launch may require a separate quote or care plan.

Payments

Pricing, payment timing, deposits, and ongoing care fees will be confirmed before work begins. Work may be paused if invoices are overdue.

Unless otherwise agreed in writing, website build fees are for the agreed project scope only. Ongoing costs such as hosting, domain renewals, care plans, email services, paid plugins, stock assets, advertising, or third-party subscriptions may be charged separately.

Launch timing

We aim to work quickly and clearly. If your package includes our 48-hour launch promise, this means that once the final site design is approved and we have the access, content, and technical details required, we can have the site online within 48 hours. This timing may be affected by domain propagation, third-party systems, missing access, late changes, or issues outside our control.

Google Business Profile and third-party listings

If Google Business Profile setup is included in your package, it is available on request during the website process and is not completed by default. You may need to provide access, verify ownership, supply business details, or complete steps required by Google. We cannot guarantee approval, ranking, review display, or search performance on Google or any third-party platform.

Third-party services

Websites may rely on third-party services such as hosting, domains, email, analytics, maps, forms, and booking or enquiry tools. Their own terms, pricing, and availability may apply.

We are not responsible for outages, price changes, policy changes, account restrictions, data loss, or service issues caused by third-party providers, although we will try to help where it is reasonable and within the services you have purchased from us.

Hosting, domains, and care plans

If we provide hosting, domain management, SSL, backups, monitoring, or content updates, the included services will depend on your care plan or written agreement. Care plans are intended for reasonable support and update requests, not unlimited redesign, new feature development, emergency work outside scope, or major content production unless agreed.

Ownership and licence

Once all amounts owing for a website build are paid, you own the final custom website content and design elements we create specifically for you, except for third-party assets, software, frameworks, templates, plugins, fonts, stock images, or tools that are licensed separately.

We retain ownership of our pre-existing processes, code snippets, know-how, internal templates, systems, and reusable methods. You grant us permission to use your business name, logo, screenshots, and project summary in our portfolio or marketing unless you ask us not to.

Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law. Our services must be provided with due care and skill, be fit for the purpose made known to us, and be supplied within a reasonable time where no time is agreed.

Where the Australian Consumer Law allows us to limit our liability, our liability may be limited to supplying the services again or paying the cost of having the services supplied again.

Limitation of liability

To the extent permitted by law, RiseDigital is not liable for indirect loss, loss of profit, lost sales, loss of data, loss of rankings, loss of goodwill, platform changes, third-party outages, security incidents outside our reasonable control, or business interruption connected with your website or services.

You are responsible for checking your website before launch and for making sure your business information, legal notices, prices, claims, and services are accurate and appropriate for your business.

Suspension or termination

We may pause or stop work if invoices are overdue, required access or content is not provided, communication becomes unreasonable, the requested work is unlawful or inappropriate, or continuing the project is no longer practical. If a project ends early, fees for work already completed or costs already incurred may still be payable.

Governing law

These terms are governed by the laws of Australia and the applicable laws of the state or territory in which RiseDigital operates, unless another jurisdiction is required by law.

Changes to these terms

We may update these terms from time to time. The version published on this page applies from the date shown above, unless we agree different terms with you in writing.
